I have fully completed this Form, and the personal information I have provided in it relates to me, contains my full name and all names previously used by me and is correct. I consent to the collection, use and disclosure of my personal information, in accordance with the Privacy and Personal Information Act 1998, for the purpose of my application under the Child Protection (Working with Children) Act 2012 (WWC Act) for a Working With Children Check (WWCC) clearance or my WWCC clearance. I understand that if I do not consent to provide my personal information in accordance with this form and as required by law, the Office of the Children's Guardian (OCG) will not be able to assess my application for a WWCC clearance and I will not be able to hold a WWCC clearance. I also authorise and consent to the following in connection with my application for a WWWC clearance and at any time while my WWCC clearance is in force: (a) the conduct of criminal record checks in relation to myself, (b) disclosure of the fact that I do not have a criminal history if: i. I work for, am applying to work for the Ministry of Health, Department of Communities and Justice, Department of Education or TAFE NSW. ii. I have applied to be engaged in child-related employment under a program licensed by the Department of Customer Service (c) other inquiries about me relevant to my application or clearance. I acknowledge that the Office of the Children's Guardian (OCG) is collecting information in this Form to provide to the Australian Criminal Intelligence Commission (ACIC), an Agency of the Commonwealth of Australia, and the Australian Police Agencies for the purposes of a National Police History Check (NPHC). I acknowledge that any information provided by me on this Form relates specifically to the purpose of obtaining a Working with Children Check (WWCC) which includes a NPHC and I consent to: • ACIC disclosing personal information about me to the Australian Police Agencies; • the Australian Police Agencies disclosing to ACIC, from their records, details of convictions and outstanding charges, including findings of guilt or the acceptance of a plea of guilty by a court, that can be disclosed in accordance with the laws of the Commonwealth, States and Territories and, in the absence of any laws governing the disclosure of this information, disclosing in accordance with the policies of the Australian Police Agency concerned; • ACIC providing the information disclosed by the Australian Police Agencies to the Office of the Children's Guardian in accordance with the laws of the Commonwealth. (Part VIIIC of the Crimes Act 1914 (Cth); Criminal Records Act 1991 (NSW); Criminal Law (Rehabilitation of Offenders) Act 1986 (QLD); Spent Convictions Act 2009 (SA); Spent Convictions Act 1988 (WA); Criminal Records (Spent Convictions) Act 1992 (NT); Spent Convictions Act 2000 (ACT); Annulled Convictions Act 2003 (TAS); Victoria Police Information Release Policy). I understand that as I am applying for a WWCC there may be exclusions from the Spent Convictions Schemes. I acknowledge that any information provided by the Australian Police Agencies or ACIC, relates specifically to the purpose of obtaining a WWCC. I acknowledge that the OCG may obtain information or documents for the purpose of assessing my WWCC application from: • the Australian Criminal Intelligence Commission • the NSW Police Force • the Director of Public Prosecutions, whether or not those documents are subject to legal professional privilege or other restrictions of disclosure; • Courts; and • Government agencies and other persons holding information about me, including misconduct reports under Schedule 1 of the WWC Act and any other information that may be lawfully disclosed to the OCG under the WWC Act or the provision of any other law. I acknowledge that the OCG may obtain identity verification information from Service NSW for the purpose of assessing my WWCC application and I consent to Service NSW releasing such information to the OCG. I acknowledge that in collating identity verification information, Service NSW may seek information from the third parties which created the original documentation, and I consent to these third parties releasing this information. I acknowledge that personal information that I provide in this Form may be disclosed to the OCG (including contractors or related bodies corporate) located in Australia or overseas for administrative purposes. I acknowledge that it is usual practice for an applicant’s personal information to be disclosed to Australian Police Agencies for them to use for their respective law enforcement purposes including the investigation of any outstanding criminal offences. I acknowledge that while a WWCC is in force, the NSW Police Force will store information about me in the NSW Police database (whether or not I have a criminal record). I acknowledge that the Children's Guardian will advise any notifiable person, including my employer and/or their authorised agent, should an interim or final bar prevent me from working in child-related work, or in the event that I have been given approval to surrender or withdraw my WWCC clearance/application. This will also apply in the case where I have lodged an application for a role or position exempt by legislation or regulation. If I am an employee of the NSW Department of Education, I acknowledge that further information will be provided detailing the legislative basis upon which an interim bar, final bar or cancellation has been imposed. I consent to the disclosure of new criminal history information to the OCG by the NSW Police Force during the currency of a WWCC. I acknowledge that new criminal history information, misconduct reports or other information lawfully obtained or received by the OCG during the currency of a WWCC may be used to re-assess my WWCC clearance. I acknowledge that information about me may be obtained from and disclosed to the National Disability Insurance Scheme Worker Check (NDISWC). This information may be used and retained for the authorised purposes set out in the WWC Act and the National Disability Insurance Scheme (Worker Checks) Act 2018 and include assessing my application for a WWCC and/or a NDISWC, ongoing monitoring of my clearance and administrative review. For the purposes of my WWCC, the OCG will have access to NDISWC information. This may include information provided by the National Disability Insurance Scheme Quality and Safeguards Commission and national police checking beyond ACIC and NSW Police Force information specified above in this notice. I acknowledge that the OCG may obtain and disclose information to bodies that administer WWCC schemes in other Australian States and Territories if: • the information is relevant to determining whether to grant, refuse or cancel a WWCC or its equivalent in another Australian State or Territory • information is recorded on the National Reference System database, including any change in status of information recorded on that database. I understand that the OCG may also disclose the following information to bodies that administer working with children checking schemes in other Australian States and Territories: • information relevant to assessing whether to grant, cancel or refuse a working with children check clearance (or equivalent in another Australian State or Territory), • personal information about a clearance holder and information that the clearance holder has been cleared to engage in child-related work. • the type of negative notice recorded on the National Reference System database and if there has been a change in status of the negative notice, that status change. I understand that I may withdraw my consent but may only do so by: • Ceasing any paid or unpaid child-related work, and; • Making a written request, and obtaining the Children’s Guardian’s consent, to surrender my WWCC Clearance. If I do not have a WWCC clearance, I understand that to withdraw consent in relation to my application for a WWCC clearance, I may only do so by: • Ceasing any paid or unpaid child-related work, and; • Making a written request to withdraw my application. I understand I can request to surrender my WWCC clearance or request to have my application withdrawn by writing to: Working with Children Check Office of the Children's Guardian Locked Bag 5100 Strawberry Hills NSW 2012 I understand that if my application is terminated or refused, I’m permitted to withdraw my application or surrender my clearance, if I am subject to an interim bar or if my clearance is cancelled, that it is an offence under Section 8(1) of the WWC Act to work or volunteer in a child-related role. I acknowledge that if I seek a review of a decision by the OCG to refuse my application to work with children or to cancel my clearance to work with children, any information that was used to assess my WWCC application may be made available to a tribunal or court in relation to the review of the decision. The information provided on this Form and which ACIC provides to the OCG will only be used for the purpose of a WWCC unless statutory obligations require otherwise. I understand that if I have already applied for a paid WWCC and have received a clearance, or if I am currently waiting for an outcome on an application for a paid WWCC, any further/additional application I submit is subject to a separate $80.00 non-refundable fee. If I am the holder of a paid or volunteer WWCC clearance, I understand that I will not be able to seek an extension to the expiry date for my WWCC clearance. I confirm that: • I understand that the provision of false and misleading information is a serious offence under the Child Protection (Working with Children) Act 2012, and • I have read and understood this information, and • I consent to the conditions above.
